Conditions of Sale
1. General information
These Conditions of Sale govern purchases made on the Bentivegna Moda website.
The products on this website are primarily intended for retail sale to end consumers, meaning individuals purchasing for purposes unrelated to their trade, business, craft or profession.
Before placing an order, customers are invited to read these Conditions of Sale and the Terms and Conditions available on the website.
2. Products
Bentivegna Moda offers clothing, footwear, accessories and products from the brands featured in its online catalogue.
Each product has a product page containing the main available information, including its description, price, sizes, colours and features.
Images are for illustrative purposes. Colours may differ slightly from the actual product depending on the features and settings of the device used.
Bentivegna Moda sells only new, authentic products.
Any trademarks and distinctive signs mentioned or reproduced on the website belong to their respective owners.
3. Prices
Prices displayed on the website are in euros, unless otherwise stated, and include VAT where applicable.
The purchase price is the price displayed to the customer when the order is completed.
Bentivegna Moda may change product prices on the website at any time.
Changes do not apply to orders already duly completed, except in the event of clerical, technical or clearly recognisable errors in the published price.
4. Orders
Customers can select products and add them to their cart.
Before completing the purchase, customers can review the selected products, quantities, prices and any applicable additional charges.
The order is submitted at the end of the website's checkout process.
After receiving the order, Bentivegna Moda will send confirmation to the email address provided by the customer.
Product availability is updated regularly. In exceptional circumstances, however, the same item may be sold simultaneously or an inventory discrepancy may occur.
If a product becomes unavailable, there is an obvious inventory or pricing error, the order cannot be fulfilled, or another objective circumstance prevents the normal completion of the sale, Bentivegna Moda will promptly inform the customer.
If payment has already been made, the amount relating to the unavailable products or cancelled order will be refunded in full, using the original payment method wherever possible.
5. Coupons and promotional codes
Coupons and promotional codes are subject to the conditions stated in the relevant promotion.
Unless expressly stated otherwise, promotional codes may not be combined with other promotions and may exclude sale products, certain brands, categories or items.
The specific conditions stated in each promotion take precedence over the general coupon conditions.
6. Payments
Customers may use the payment methods available and displayed at checkout.
Transactions are processed through secure payment systems in accordance with the procedures of the respective providers.
Bentivegna Moda does not directly obtain or store full payment card details when those details are managed by payment service providers.
7. Shipping within Italy
Bentivegna Moda ships with DHL, GLS and UPS, selecting the most suitable carrier according to the destination and available service.
Shipping within Italy is free for orders over €150.00.
For orders below €150.00, shipping costs €7.00.
Orders are normally prepared within two business days and handed to the carrier Monday to Friday, excluding public holidays.
8. International shipping
Shipping within Europe is free for orders over €300.00, subject to the destinations and conditions specified in the Shipping Policy.
Shipping to non-EU countries is free for orders over €600.00, where the service is available.
Charges for orders below the relevant thresholds are displayed at checkout or in the Shipping Policy.
Shipments to non-EU countries may be subject to customs duties, import taxes or other charges imposed by the destination country's authorities.
When these amounts are not already included in the total paid at checkout, they remain the recipient's responsibility.
9. Delivery times and tracking
Delivery times are estimates and run from the date the order is handed to the carrier.
Estimated delivery times:
- Italy: 1–3 business days;
- EU countries: 4–5 business days;
- Non-EU European countries: 5–6 business days;
- Rest of the world: 5–7 business days with Express service.
Times may vary depending on the destination, time of year, carrier and any customs procedures or circumstances beyond Bentivegna Moda's control.
Once the shipment has been handed to the carrier, the customer will receive a tracking number, where available.
10. Checking the shipment on delivery
Customers are invited to check the condition of the packaging on delivery.
If there are clear signs of damage, opening or tampering, customers are invited to accept the parcel with a specific written reservation describing the issue, or, in more serious cases, refuse delivery.
Any problems must be reported promptly to Bentivegna Moda Customer Service, preferably with photographs of the packaging and product received.
11. Right of withdrawal
Consumer customers making an online purchase may exercise their right of withdrawal without giving a reason within 14 days of taking physical possession of the products.
For a single order containing several products delivered separately, this period begins on delivery of the last product.
Customers can request a return through their Bentivegna Moda Customer Account or notify Customer Service of their decision to withdraw by an explicit statement.
After giving notice of withdrawal, products must be returned without undue delay and in any event within 14 days.
Products must be returned intact, complete with tags, labels and any original accessories, and must not have been used beyond what is necessary to check their nature, characteristics and fit.
Customers are responsible for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product.
Statutory exclusions from the right of withdrawal remain applicable.
12. Return costs within Italy
For returns from Italy, customers can choose between two options.
Self-arranged shipping: customers may arrange the return directly with a carrier of their choice and pay the relevant cost. In this case, Bentivegna Moda will not charge a return fee and no return shipping amount will be deducted from the refund.
Bentivegna Moda shipping label: customers may request the return service arranged by Bentivegna Moda. A charge of €6.90 per return request applies, regardless of the number of items included in the same shipment. This amount may be deducted from the refund.
Tracked shipping and suitable packaging are recommended in both cases.
If a product is incorrect, damaged or defective for reasons attributable to Bentivegna Moda, customers must contact Customer Service before returning it. Bentivegna Moda will bear the relevant costs in the cases provided for by applicable law.
13. International returns
For returns from countries other than Italy, customers bear the direct return costs, except where a product is incorrect, damaged or defective for reasons attributable to Bentivegna Moda.
Customers must use tracked shipping and ensure that products are suitably packaged.
Any duties, customs taxes or other charges associated with an international return remain the customer's responsibility to the extent permitted by applicable law.

15. Refunds
Once the return has been received, Bentivegna Moda will check the condition of the returned products.
Where the right of withdrawal is duly exercised, the refund will be made within the time limits required by applicable law.
The refund will be made using the original payment method, unless otherwise agreed without any cost to the customer.
If the withdrawal concerns the entire order, any original standard delivery costs paid by the customer will also be refunded.
Any additional costs resulting from the choice of a more expensive delivery method than the standard delivery offered by Bentivegna Moda will not be refunded.
Bentivegna Moda may withhold the refund until it receives the products or until the customer provides evidence of having sent them back, whichever occurs first.
If the customer used the shipping label provided by Bentivegna Moda, the €6.90 charge may be deducted from the refund.
16. Statutory guarantee of conformity
All products sold to consumers benefit from the statutory guarantee of conformity provided for in Articles 128 and subsequent articles of the Italian Consumer Code.
For new goods, the seller is liable for a lack of conformity that becomes apparent within two years of delivery, as provided for by applicable law.
In the event of a lack of conformity, consumers are entitled to the remedies provided by law, including, subject to the conditions of the Italian Consumer Code, repair or replacement and, where the relevant requirements are met, a price reduction or termination of the contract.
The guarantee excludes damage caused by normal wear and tear, improper use, negligence, accidental events or use inconsistent with the product's normal intended purpose.

19. Updates to these conditions
Bentivegna Moda may update these Conditions of Sale to reflect changes to its services or applicable legislation.
Each purchase is governed by the conditions in force when the order is completed.
20. Applicable law
These Conditions of Sale are governed by Italian law, without prejudice to consumers' mandatory rights under applicable national and European legislation.
